1. Scope of Application

These Terms and Conditions (T&C) of amadia – young diamonds e.U. (hereinafter referred to as "we/us") apply to all orders placed by consumers via our online shop.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

For all orders placed and for any legal transactions concluded in connection with the webshop, these T&C shall apply exclusively. By submitting an order in the webshop, the customer expressly agrees that these T&C form part of the contractual agreement.

We expressly reject any terms and conditions of the customer that deviate from or conflict with these T&C, unless we have expressly agreed to their validity in writing.

2. Contracting Party, Conclusion of Contract

The purchase contract is concluded with amadia – young diamonds e.U.

By presenting products in the online shop, we do not make a binding offer to conclude a purchase contract. You may place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained in the order process.

By clicking the order button, you submit a legally binding offer to purchase the goods in your shopping cart. Immediately after submitting your order, you will receive an email confirmation of receipt. This order confirmation does not constitute acceptance of your offer but merely informs you that we have received your order.

A purchase contract is only concluded when we ship the product to you and confirm the shipment with a second email (shipping confirmation). No purchase contract is concluded for products from the same order that are not listed in the shipping confirmation.

We reserve the right not to accept an offer if an item is unavailable, if you have unjustifiably failed to pay invoices from previous deliveries, if your credit card check cannot be successfully completed, or if there are other legitimate doubts about your creditworthiness. If we cannot process an order, we will inform you as soon as possible.

3. Contract Language

The languages available for concluding the contract are German and English.

4. Prices and Shipping Costs

All prices include statutory value-added tax (VAT). Additional shipping costs may apply depending on the destination country, which also include statutory VAT. Details of shipping costs can be found here

For deliveries outside the European Union, additional costs may be incurred by the customer, such as import duties (e.g., customs) or additional charges for money transfers by credit institutions.

We deliver exclusively by shipping. Self-collection of goods is unfortunately not possible. We do not deliver to parcel stations.

5. Delivery

Delivery will be made to the delivery address specified by the customer in the order. The customer is obliged to immediately notify us of any changes to their contact details (in particular address and email address) as long as the contractual obligations have not been fulfilled by both parties. Until such time, we are entitled to send legally relevant declarations to the originally provided contact details.

Delivery is carried out, depending on the customer’s delivery address, by different shipping service providers, to whom – in order to perform delivery – the delivery address, email address, and telephone number of the customer will be disclosed.

If delivery is not possible because the customer cannot be reached at the specified delivery address or because the delivery address was provided incorrectly, the customer shall bear the costs for the unsuccessful delivery attempt as well as any return shipping costs incurred.

6. Retention of Title

Ownership of the delivered goods shall not pass to the customer until full payment of the purchase price has been made.

7. Payment

Our shop generally offers various payment methods, which are displayed at the beginning of the order process.

If you select a payment method offered via the payment service "Shopify Payments," payment will be processed by the payment service provider Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland ("Stripe"). The specific payment methods available via Shopify Payments are displayed in our online shop. To process payments, Stripe may use additional payment services, for which separate payment terms may apply. You may be specifically informed about such conditions. If you select a payment method offered via PayPal, you will be redirected to the website of the online provider PayPal (PayPal (Europe) S.à r.l. et Cie, S.C.A., 22–24 Boulevard Royal, L-2449 Luxembourg). To pay the invoice amount via PayPal, you must be registered there (or register first), log in with your access data, and confirm the payment instruction to us. After placing the order in the shop, we will instruct PayPal to initiate the payment transaction. The payment transaction will then be carried out automatically by PayPal. You will receive further information during the ordering process.

PayPal may offer additional payment options to registered and selected PayPal customers. We have no influence over such options; any additional individually offered payment methods are subject solely to your contractual relationship with PayPal. 8. Gift Cards

Gift cards from amadia – young diamonds can be redeemed exclusively in the online shop.
To redeem a gift card, its code must be entered into the designated field during the order process. The value of the gift card will automatically be deducted from the invoice amount.

Only one gift card can be redeemed per order. Cash payment of the gift card value or of any remaining balance is excluded. The order value must always exceed the value of the redeemed gift card.

Gift cards can only be used for the purchase of goods and not for the purchase of additional gift cards. They cannot be combined with other discounts or promotions.

Gift cards are generally transferable. The holder of the gift card is considered authorized to redeem it in the online shop. However, we do not assume liability for the loss, theft, or unauthorized use of gift cards.

9. Right of Withdrawal for Consumers

If the customer is a consumer (i.e., a natural person who places the order for purposes that are predominantly outside their trade, business, or profession), the customer has a statutory right of withdrawal.

10. Warranty and Guarantees

Statutory warranty rights apply. Information on any applicable additional guarantees and their exact conditions can be found with the product and on special information pages in the online shop.

As a consumer, you are requested to check the goods immediately upon delivery for completeness, obvious defects, and transport damage and to notify us and the carrier of any complaints as soon as possible. Failure to do so will not affect your statutory warranty claims.

11. Dispute Resolution

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

12. Applicable Law

The legal transaction concluded via the online shop between amadia – young diamonds e.U. and the customer shall be governed exclusively by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and conflict-of-law provisions.
